Terms of service

Welcome to Lucullion. These Terms of Service govern your use of lucullion.com (the "Site") and any purchase you make from us. By using the Site you agree to be bound by them. If you do not agree, please do not use the Site.

We may update these Terms from time to time. The version published on the Site at the time of your order is the version that applies to that order. Continued use of the Site after a change constitutes acceptance of the revised Terms.

1. Who we are

Lucullion is a DIY gifts and hobby retailer operating from Austin, Texas. We can be reached at support@lucullion.com for order and service matters, and at contact@lucullion.com for all other enquiries.

2. Eligibility

You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. Some products we sell contain small parts, strong magnets, or concentrated fragrance materials and are not suitable for young children. Product pages carry the relevant warnings and you agree to observe them.

3. Accounts

You may create an account to view your order history and track deliveries. Accounts are hosted and secured by Shopify and use a one-time code sent to your email address rather than a password. You are responsible for maintaining access to that email address and for activity carried out through your account.

An account is not required. Orders may be placed as a guest.

4. Orders

Submitting an order is an offer to purchase. It does not constitute acceptance by us. We may accept or decline any order, or any part of an order, at our discretion, including after an order confirmation has been sent or payment taken. Where we decline an order that has already been paid for, we refund it in full.

We may limit order quantities on any item, and we may decline to supply any customer.

5. Pricing and payment

Prices are shown in United States dollars and exclude any tax applied at checkout. Payment is taken at the time of order through the payment methods offered on the Site.

We make every effort to price accurately. Where an item is listed at an incorrect price, we may cancel the order and refund it in full rather than supply at the listed price, even where payment has been taken.

6. Shipping, returns and refunds

Shipping terms are set out in our Shipping Policy. Returns, replacements, and refunds are set out in our Refund Policy. Both form part of these Terms.

7. Product descriptions and images

We describe our products as accurately as we are able, including materials, dimensions, and capacities. We do not warrant that every description, image, or specification is free of error or entirely current. Colors and finishes may appear differently on your screen than in person.

Where a product is described as compatible with an item made by another company, that description is an indication of fit only and does not imply any association with or endorsement by that company.

8. Customization and personalization

Some products may be customized. Where personalization is applied to your instructions — a name, an engraving, or similar — you are responsible for the accuracy of the text you supply, and the item cannot be returned or exchanged once produced. Configuration choices that do not personalize the item itself do not affect your return rights.

We may decline to produce personalization that is unlawful, infringes another party’s rights, or that we consider offensive.

9. The Workbench

The Workbench allows you to tell us about a product you need that does not exist or has not been made well. Please read this section before submitting.

Submissions are not confidential and create no obligation on our part.

By submitting an idea, request, or suggestion, you grant Lucullion a perpetual, irrevocable, worldwide, royalty-free license to use, develop, manufacture, and sell products based on it, without compensation, attribution, or any further permission from you. You confirm that the submission is yours to give and does not infringe anyone else’s rights.

We receive many similar requests, and we may already be working on something comparable. Nothing in a submission restricts what we may develop independently. If we build something you asked for, we will usually say so on our progress board, but we are not obliged to.

Do not submit anything you consider confidential or wish to keep ownership of.

10. Private Gifting

The Private Gifting service is governed by the Private Gifting terms published on the Site, which form part of these Terms. In summary: we receive an item from you, inspect it, remove identifying paperwork, wrap it, and forward it to a recipient at an address you provide, without disclosing your details to that recipient.

You must be the lawful owner of any item you send us, and you must accurately declare what it is and what it is worth. We open and inspect every parcel. We may refuse, hold, or return any shipment at our discretion, and we will tell you why.

Our liability for loss or damage to an item in our care is limited to the lower of the value you declared or the coverage ceiling purchased with that order. We do not accept items declared above the maximum stated on the Private Gifting page.

11. Reviews and other content you submit

If you submit a review, photograph, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our products and marketing, including on third-party marketplaces. You may ask us to remove your content at any time by writing to us.

You are responsible for what you submit. Do not submit anything unlawful, misleading, or that infringes another party’s rights.

12. Acceptable use

You agree not to use the Site to break any law, to interfere with its operation or security, to scrape or harvest data by automated means, to resell our products in a way that misrepresents their origin, or to impersonate another person.

13. Intellectual property

All content on the Site — text, graphics, logos, photographs, product designs, and instructional material — is the property of Lucullion or its suppliers and is protected by United States and international law. You may not reproduce, distribute, or create derivative works from it without our written permission.

Trademarks belonging to other companies, including grading companies and trading card publishers, are the property of their respective owners and are used on the Site solely to describe compatibility. We are not affiliated with, endorsed by, or sponsored by any of them.

14. Third-party marketplaces

We also sell through Amazon, Etsy, TikTok Shop, and Michaels MakerPlace. Purchases made on those platforms are governed by the terms and policies of the platform on which they were made, not by these Terms. Where a policy differs, the platform’s terms apply to that order.

15. Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

Instructional content, including our guides and courses, is provided for educational purposes. You are responsible for following the safety guidance supplied with any product and for handling materials appropriately.

16. Limitation of liability

To the fullest extent permitted by law, Lucullion is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Site or any product purchased from it.

Our total liability in connection with any order is limited to the amount you paid for that order, except in respect of the Private Gifting service, where the limit set out in section 10 applies.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Lucullion, its officers, employees, and suppliers from any losses, damages, and reasonable legal costs arising from your breach of these Terms or from activity carried out through your account.

18. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.

19. Entire agreement and severability

These Terms, together with the Privacy Policy, Shipping Policy, Refund Policy, and Private Gifting terms, constitute the entire agreement between you and Lucullion regarding the Site. If any provision is held invalid or unenforceable, it shall be severed and the remaining provisions shall continue in effect.
